1. About BigDogButtons

BigDogButtons is a custom button and print manufacturing company operating in Los Angeles, California. We produce custom pinback buttons, printed materials, and related products for individuals, businesses, and organizations across the United States.

2. Orders and Order Acceptance

2.1 Order Placement

All orders are subject to acceptance by BigDogButtons. We reserve the right to refuse or cancel any order for any reason, including product unavailability, errors in pricing or specifications, suspected fraud, content that violates our standards, or failure to provide adequate artwork files.

2.2 Order Confirmation

An order is not confirmed until you receive a written order confirmation from BigDogButtons. Automated payment receipts alone do not constitute order acceptance.

2.3 Pricing

All prices are in U.S. dollars. Prices are subject to change prior to order confirmation. Once confirmed in writing, prices are fixed. Rush surcharges, if applicable, are presented during checkout and included in the order confirmation.

3. Payment

3.1 Standard Payment

Payment in full is required before production begins. We accept major credit and debit cards via Stripe.

3.2 Net 30 Credit Accounts

Qualified business customers may apply for a Net 30 credit account. The following apply to all Net 30 accounts:

• Invoices are due in full thirty (30) days from the invoice date
• Past-due balances accrue interest at 1.5% per month (18% per annum), or the maximum rate permitted by California law, whichever is less
• BigDogButtons reserves the right to suspend production on future orders for any account with a past-due balance
• If legal proceedings are necessary to collect a past-due balance, you agree to reimburse BigDogButtons for all reasonable costs of collection, including court costs and attorneys' fees

3.3 Taxes

Applicable sales taxes are calculated at checkout based on your shipping or pickup location. Tax-exempt customers must provide a valid exemption certificate at the time of ordering.

4. Artwork and Intellectual Property

4.1 Customer Warranty of Ownership

By submitting artwork, logos, images, or other creative materials ("Customer Content"), you represent and warrant that you own all intellectual property rights in the Customer Content or have obtained all necessary licenses and permissions; that the Customer Content does not infringe any third-party rights; and that you have the legal right to grant us the license described in Section 4.2.

4.2 License Grant

By submitting Customer Content, you grant BigDogButtons a limited, non-exclusive, royalty-free license to use, reproduce, modify, and process the Customer Content solely to fulfill your order. This license terminates upon order completion. We do not claim ownership of your artwork.

4.3 Indemnification for IP Claims

You agree to defend, indemnify, and hold harmless BigDogButtons from any claims, damages, and expenses (including attorneys' fees) arising from any allegation that your Customer Content infringes any third-party intellectual property right or violates applicable law.

4.4 File Standards

You are responsible for submitting print-ready artwork files meeting our technical specifications. We are not responsible for output quality issues resulting from low-resolution artwork or incorrect file formats.

5. Proof Approval

5.1 Digital Proofs

For most custom orders, we provide a digital proof for your review before production. It is your responsibility to carefully inspect the proof for spelling, grammar, color accuracy, artwork placement, sizing, and overall accuracy.

5.2 Approval Sign-Off and Liability

Once you approve a proof — whether by clicking "Approve" in the portal, written email approval, or any other affirmative acknowledgment — BigDogButtons assumes no responsibility and will not issue refunds or free reprints for any errors present in the approved proof, including typographical errors, incorrect artwork, color discrepancies, or layout issues.

5.3 Color Disclaimer

Colors in digital proofs may not perfectly match the final printed product due to variations in monitors and printing processes. Exact color matching is not guaranteed unless specifically arranged and paid for.

5.4 Deemed Approval

If you do not respond to a proof request within five (5) business days after reasonable contact attempts, BigDogButtons reserves the right to treat the order as approved and proceed, or to place the order on hold.

6. Content Standards

BigDogButtons reserves the right to refuse production of any Customer Content that is unlawful, obscene, defamatory, or pornographic; depicts or promotes violence or hatred; infringes or potentially infringes third-party intellectual property rights; or that we determine in our sole discretion to be offensive or inappropriate.

7. Production Times and Rush Orders

7.1 Standard Production

Standard production turnaround times are estimates and are not guaranteed. BigDogButtons is not liable for delays caused by factors outside our reasonable control, including material supply delays, carrier delays, equipment failures, or acts of God.

7.2 Rush Order Surcharges

• Same-Day (pickup only): +60% surcharge — must be placed and approved before daily cutoff
• Rush (1–2 business days): +40% surcharge
• Expedited (3–4 business days): +20% surcharge

Rush surcharges are non-refundable once production has begun. For orders exceeding $2,000, rush orders may require additional approval; unapproved high-value rush orders may be automatically cancelled after 24 hours.

7.3 SLA Commitments

Rush SLA dates are target commitments based on your chosen tier and order placement time, calculated using production hours (Mon–Fri 8:30 AM–5:30 PM, Sat 10:00 AM–2:00 PM PT). Our sole obligation for an SLA miss due to a BigDogButtons production error is a refund of the rush surcharge paid.

8. Shipping and Delivery

8.1 Carrier and Title

We ship via UPS, USPS, and FedEx. Title and risk of loss pass to you upon delivery to the carrier. BigDogButtons is not responsible for carrier delays, lost packages, or damage in transit.

8.2 Local Pickup

Orders not picked up within 30 calendar days of the ready notification may be shipped to your address on file at your expense or treated as abandoned.

8.3 Blind Shipping

By requesting blind shipping, you warrant that use of a third-party sender address is authorized, and you assume full responsibility for any compliance matters. Carrier internal records may still reflect underlying origin information.

9. Claims, Returns, and Reprints

9.1 Claim Window

All claims for defects, damage, or errors must be submitted in writing within ten (10) calendar days of receipt. Any claim not presented within this period is waived. Email orders@bigdogbuttons.com with photographic evidence and your order number.

9.2 Remedies

Our sole obligation for a verified production defect is, at our election, to reprint and reship the affected items or to issue a credit toward a future order. We do not issue cash refunds once production has begun.

9.3 No Warranties

BigDogButtons makes no express or implied warranties regarding products or printing services, including warranties of merchantability or fitness for a particular purpose.

9.4 Cancellations

Orders may be cancelled without penalty prior to proof approval. Once production has begun, orders may not be cancelled and rush surcharges are non-refundable.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: BIGDOGBUTTONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. BIGDOGBUTTONS' TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. YOUR SOLE REMEDY FOR A PRODUCTION ERROR IS A REPRINT OR CREDIT AS DESCRIBED IN SECTION 9.2.

11. Indemnification

You agree to defend, indemnify, and hold harmless BigDogButtons and its officers, employees, and agents from any claims, damages, and expenses arising from your breach of these Terms, your Customer Content, your violation of any law or third-party rights, or your unauthorized use of our Services.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California. Any dispute shall be resolved exclusively in the state or federal courts of Los Angeles County, California. Before initiating formal proceedings, contact us at legal@bigdogbuttons.com to attempt informal resolution.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated by email or website notice. Continued use of our Services after changes are posted constitutes acceptance.
